well, you see the National Organization Association, which was among the complainants that brought this case challenging the constitutionality of the law, got a federal court to state that the act is unconstitutional in finding that Congress, you understand, actually overstepped its bounds by mandating services to report their advantageous ownership details or what we refer to as the BOI.

Now, the court specified that despite acknowledging the Act’s worthy intentions against the cash laundering, it still had to strike it down, specifying that there’s no precedent allowing Congress such substantial powers over businesses simply because they’re included.
You know, the government, you know, they threw whatever they had at this one, too.
They said, Hey, we have actually got foreign affairs powers, we have the Commerce stipulation, we have taxing authority.

But the court didn’t purchase any of it, pointing out cases in specifying that Congress has other methods to achieve these goals without the overreaching element of the CTA.
Truly, all of it boils down to constitutional limitations.

This court stressed that while the objectives to counteract financial criminal activities are commendable, there are lines that Congress just can not cross.
